understand them, and
-
agree to be legally bound by them.
If you do not agree with any part of these Terms, you must not use the Website or purchase our products.
These Terms apply to all users, including visitors, customers, and subscription users, and cover both one-time purchases and recurring (subscription) orders.

These Terms should be read together with our:

Shipping & Delivery Policy
https://myhypha.com/shipping-delivery/ -
Returns & Cancellation Policy
https://myhypha.com/returns-cancellation/ -
Privacy Policy (where applicable)
In the event of any inconsistency, the specific policy applicable to the matter (e.g. Shipping or Returns) shall prevail.
2. Products, Orders & Order Acceptance
Hypha offers skincare and related products for personal use only. All product descriptions, images, ingredients, and other content on the Website are provided for general informational purposes.
While we make reasonable efforts to ensure that product information is accurate and up to date, we do not guarantee that descriptions, images, pricing, availability, or other content will always be complete, current, or error-free. Minor variations in packaging, labeling, or appearance may occur and do not affect product quality.
Placing an Order
By placing an order through the Website, you confirm that:
-
all information provided is accurate and complete,
-
you are authorized to use the selected payment method, and
-
you intend to complete the purchase.
Submitting an order does not constitute acceptance by Hypha. An order is considered accepted only when:
-
payment has been successfully authorized or captured, and
-
you receive an order confirmation email from us.
We reserve the right to refuse, cancel, or limit any order at our sole discretion, including but not limited to cases involving:
-
suspected fraud, abuse, or unauthorized activity,
-
incorrect, incomplete, or misleading customer information,
-
pricing or typographical errors,
-
abnormal or excessive purchase quantities,
-
violations of these Terms or applicable laws.
If an order is cancelled after payment has been captured, any eligible refund will be processed in accordance with our Returns & Cancellation Policy.
Product Availability & Errors
All products are subject to availability. We do not guarantee that any product will be in stock at all times.
In the event of an error relating to product availability, pricing, promotions, or descriptions, we reserve the right to correct such errors and to cancel affected orders, even after an order confirmation has been sent. In such cases, you will be notified and refunded where applicable.
Personal Use Only
Products purchased from Hypha are intended for personal, non-commercial use only. Resale, redistribution, or commercial exploitation of our products without prior written consent is strictly prohibited.
3. Pricing, Payments & Subscriptions
Pricing
All prices displayed on the Website are shown in the applicable currency and include or exclude taxes as indicated at checkout. Shipping costs, taxes, customs duties, or other fees (if applicable) are clearly displayed before completing your purchase.
We reserve the right to change product prices, promotions, or offers at any time. Price changes do not affect orders that have already been accepted.
Payments & Billing
We accept payments through secure third-party payment processors, including Stripe and PayPal. Hypha does not store or have direct access to your full payment card details.
By submitting payment information, you confirm that:
-
you are authorized to use the selected payment method,
-
the payment information provided is accurate and complete, and
-
you authorize us (or our payment providers) to charge the applicable amount, including recurring charges where applicable.
Payments may be subject to authorization prior to capture. In some cases, funds may be temporarily held by your payment provider before final settlement.
If a payment cannot be successfully processed, we reserve the right to:
-
suspend or cancel the order,
-
retry the payment where permitted, or
-
request an alternative payment method.
Subscriptions & Recurring Billing
Some products may be offered as subscription (recurring) purchases.
By purchasing a subscription, you expressly agree that:
-
your payment method will be automatically charged on a recurring basis,
-
charges will continue until the subscription is cancelled, and
-
you are responsible for managing or cancelling your subscription in a timely manner.
Subscription Disclosure
Subscription details, including:
-
billing amount,
-
delivery interval, and
-
renewal frequency
are clearly displayed:
-
at checkout before purchase,
-
in the order confirmation email sent after purchase, and
-
in your customer dashboard.
If a product is identified as a subscription and no specific interval is stated, the default renewal interval is every 30 days.
Managing or Cancelling a Subscription
Subscriptions can be managed, paused, or cancelled through your customer account, accessible via the Website or hypha.adpulse.tech/customer/login, using the email address associated with the original order.
Changes must be made before the next billing and processing date to apply to the upcoming charge or shipment.
Once a subscription payment has been processed for a billing cycle, it cannot be reversed for that cycle except as expressly stated in our Returns & Cancellation Policy.
Failed Payments
If a recurring or one-time payment fails:
-
we may attempt to reprocess the payment,
-
subscription deliveries may be paused or cancelled, and
-
access to subscription benefits may be suspended until payment is successfully completed.
Third-Party Payment Providers
All payment transactions are subject to the terms, conditions, and privacy policies of the respective payment provider (e.g. Stripe or PayPal). Hypha is not responsible for errors, interruptions, or actions taken by third-party payment processors.
For more information on cancellations, refunds, and subscriptions, please review our Returns & Cancellation Policy:
https://myhypha.com/returns-cancellation/
4. Cancellations, Returns & Refunds
Order Cancellations
Orders may be cancelled only if they have not yet entered processing.
Cancellation requests must be submitted within 14 hours from payment confirmation. This rule applies to both one-time purchases and subscription orders (per billing cycle).
Once an order or subscription shipment has entered processing or has been dispatched, it cannot be cancelled.
Returns & Refund Eligibility
Returns and refunds are subject to specific conditions and limitations. Eligibility depends on factors such as product condition, order type (one-time or subscription), and timing.
Not all orders are eligible for returns or refunds.
Detailed and binding rules regarding:
-
return eligibility,
-
refund methods,
-
subscription cancellations,
-
non-acceptance of delivery, and
-
exceptions
are outlined in our Returns & Cancellation Policy, which forms an integral part of these Terms:
https://myhypha.com/returns-cancellation/
Subscription Orders
Subscription orders are billed automatically and processed according to the selected delivery interval.
If a subscription order has already been billed or processed for a given cycle, it cannot be cancelled or refunded for that cycle, except where required by applicable law.
Managing or cancelling a subscription must be done before the next billing and processing date via your customer account.
Refund Processing
Approved refunds are issued to the original payment method used for the purchase, unless the order was paid using a gift voucher or store credit, in which case refunds are issued as store credit only.
Refunds are processed within a reasonable timeframe after approval and, where applicable, receipt of returned items. Processing times may vary depending on the payment provider (e.g. Stripe or PayPal).
Payment Disputes
Before initiating a chargeback or payment dispute with your bank or payment provider, you agree to contact us directly and allow us a reasonable opportunity to resolve the issue.
Unwarranted chargebacks or abusive refund behavior may result in:
-
suspension of your account,
-
cancellation of active subscriptions, or
-
refusal of future orders.
5. Shipping, Delivery & Risk Transfer
We ship orders in accordance with the shipping options and delivery estimates displayed at checkout.
Estimated delivery times are provided for reference only and are not guaranteed. Delays may occur due to factors beyond our control, including carrier delays, customs procedures, weather conditions, public holidays, or force majeure events.
Detailed and binding shipping terms, including delivery times, shipping costs, address requirements, and subscription delivery rules, are outlined in our Shipping & Delivery Policy, which forms an integral part of these Terms:
https://myhypha.com/shipping-delivery/
Risk Transfer
All products are inspected and dispatched in proper condition.
Once an order is handed over to the shipping carrier or third-party logistics provider (3PL), the risk of loss or damage transfers to the customer, to the extent permitted by applicable law.
Hypha is not responsible for:
-
delays caused by shipping carriers or customs authorities,
-
damage occurring during transit,
-
packages marked as “delivered” by the carrier but not received,
-
theft or loss after delivery to the address provided by the customer.
Delivery Address & Acceptance
Customers are responsible for providing a complete and accurate delivery address at checkout.
Failure to accept delivery, refusal of delivery, or failure to collect a shipment from the carrier or pickup location is considered a breach of these Terms. In such cases:
-
the order will not be refunded,
-
shipping and handling costs will not be reimbursed,
-
returned or unclaimed shipments may be disposed of at our discretion.
Subscription Deliveries
For subscription orders, shipping conditions and delivery intervals are disclosed at checkout and apply to each recurring shipment unless otherwise stated.
If no separate subscription shipping terms are provided, recurring orders are shipped under the same conditions as the initial order.
6. Product Condition, Defects & Transit Damage
All products are inspected and leave our facility in proper condition and in accordance with applicable quality standards.
Product Defects
A product defect is limited to a manufacturing or quality issue that existed prior to shipment.
If you believe you have received a defective product, you must contact us promptly with:
-
your order details, and
-
clear photos or other reasonable evidence.
We reserve the right to assess the claim and determine whether the issue qualifies as a product defect. Approved defect claims are handled in accordance with our Returns & Cancellation Policy.
Transit Damage & Shipping-Related Issues
Hypha is not responsible for damage caused during transit by third-party logistics providers (3PL), shipping carriers, or postal services.
Transit-related issues include, but are not limited to:
-
damaged or broken packaging,
-
leaks, dents, or cracks,
-
cosmetic damage caused by handling or transportation.
Damage occurring during transit does not qualify as a product defect and is not eligible for refunds or replacements.
Returned Items & Risk
Hypha does not assume responsibility for items lost or damaged while being returned.
Customers are solely responsible for return shipments and are strongly encouraged to use a trackable shipping service and, where appropriate, purchase shipping insurance when returning products.
7. Failed Deliveries, Non-Acceptance & Unclaimed Orders
Customers are responsible for ensuring that they are available to receive deliveries and that the delivery address provided is correct and accessible.
Failed or Unclaimed Deliveries
If a delivery fails due to reasons attributable to the customer, including but not limited to:
-
incorrect or incomplete delivery address,
-
failure to accept delivery,
-
failure to collect the shipment from the carrier or pickup location,
-
refusal of delivery without prior authorization,
the order will be considered unclaimed or non-accepted.
Consequences of Non-Acceptance
Non-acceptance or failure to collect a shipment constitutes a breach of these Terms.
In such cases:
-
the order is not eligible for a refund,
-
original shipping costs and any return shipping costs are non-refundable,
-
the shipment may be returned, abandoned, or disposed of at our discretion.
Carrier Marked as Delivered
If a shipment is marked as “delivered” by the carrier to the address provided at checkout, the order will be considered successfully delivered, regardless of whether the customer personally received the package.
Hypha is not responsible for loss or theft occurring after confirmed delivery.
8. Chargebacks, Disputes & Abuse Prevention
If you have any questions or concerns regarding a charge, order, delivery, or product, you agree to contact us first and allow us a reasonable opportunity to resolve the issue before initiating a chargeback or payment dispute with your bank or payment provider.
Payment Disputes & Chargebacks
Initiating a chargeback or dispute without first contacting Hypha may result in:
-
suspension or termination of your customer account,
-
cancellation of active subscriptions, and
-
refusal of future orders.
We reserve the right to provide payment providers (including Stripe and PayPal) with all relevant order information, delivery confirmations, communication records, and policy documents to resolve disputes.
Abuse Prevention
To protect our business and customers, we reserve the right to restrict, suspend, or terminate accounts or transactions where we reasonably suspect:
-
fraudulent activity,
-
abuse of refund, return, or chargeback processes,
-
repeated non-acceptance of deliveries,
-
violation of these Terms or related policies.
Such actions may be taken without prior notice where permitted by law.
Good Faith Requirement
All purchases and refund requests must be made in good faith. We do not tolerate abusive behavior, false claims, or misuse of our services.
9. User Accounts, Communications & Electronic Notices
User Accounts
Certain features of the Website, including subscription management, order history, and billing information, may require a customer account.
Customer accounts are associated with the email address used to place the original order. You are responsible for ensuring that your contact information remains accurate and up to date.
You are solely responsible for all activity that occurs under your account. Hypha is not liable for any loss or damage resulting from unauthorized access to your account, except where required by applicable law.
